Overview

Terms of Service or Terms and Conditions, are legal agreements that govern the users of a service. These Terms often appear as disclaimers that must be agreed to in order to use a service. 

This document addresses matters such as service provider’s and user’s rights and responsibilities, accountability for actions and conduct, 

a privacy policy addressing personal data, payment details based on what is agreed upon, opt-in and opt-out policies for communications, and details of contract termination. The Service Agreement - when concluded - will be attached with the Terms and Conditions document as well. 

Client’s Rights & Responsibilities

Rights:

  • Client has the right to request and use all the information needed before agreeing on the service.

  • Client has the right to propose adjustments of the service agreement and discuss the details. 

  • Client has the right to request all the data available regarding the real estate presentations made by the service provider. 

  • Clients have the right to make their own valuation and offer upon the property.

  • Clients have the right to request the final purchasing contract to be made under certain conditions. 

  • Clients have the right to terminate the Agreement of Service with Access Albania if the latter does not respect the Agreement. 

  • Clients have the right to contact Access Albania any time for any question regarding the service they have agreed upon. 

  • Clients have the right to request their data to be deleted and not be used for any further real estate update. 

  • Clients have the right to be provided with the full service agreed on with the service provider.

  • Clients have the right to send to Access Albania any property they see in the market, with the purpose of being consulted by the Service Provider.

Responsibilities:

  • Respecting the Service Agreement including all the terms and conditions agreed with Access Albania.

  • Responding to the investment condition details requested by the Service Provider in help of the mutual purpose. 

  • Following the Purchasing Contract based on the conditions agreed on. 

Service Provider’s Rights & Responsibilities

Rights:

  • Service Provider (SP) has the right to be correctly informed about the clients’ conditions of their Investment Request. 

  • SP has the right to propose adjustments on the Service Agreement and discuss them with the client.

  • SP has the right to use all the data provided by the client with the purpose of completing the full service. 

  • SP has the right to request more information from the client if it's needed.

  • Consulting and proposing the best real estate options for the client based on an analysis. 

Responsibilities:

  • Respecting the Service Agreement including all the terms and conditions agreed with the client.

  • Following the entire process of service and being responsible for every information it provides to the client. 

  • Letting the client know the reason for the information requested by the SP. 

  • Updating the client consistently for the process, what has been done, where the situation is, and what is to be expected and done. 

  • Being fully transparent to any information it provides to the client.

  • Respecting the request of the clients regards to their data privacy. 

  • Respecting the Privacy Policy.

  • In case of Reservation Agreement, the Seller Provider will hold the amount provided by the investor for the purpose of reservation, until the notarization of the Purchasing Contract. Then, the amount will be returned to the buyer and buyer has the responsibility to make the payment agreed on the Service Agreement with Access Albania.

  • Updating the client for any potential or concrete change regarding the property. 

  • Following the process until the Purchasing Contract and the transfer of the Ownership Certificate.

Accountability for actions and conduct:

  • The Service Provider does not have the right to turn property offers into an auction above the first requested price for the property. 

  • Property will continue to be on the market for sale as long as it is not Reserved via a Reservation Agreement. 

  • Some properties are accessed by tens of agents and sellers, so even if we are in a negotiation process, the Service Provider can't reserve the property if there is no agreement yet between the seller and the buyer. So, that means it can be sold anywhere else as long as it is in an open market.

  • Clients cannot make real estate purchases with agents or sellers in the market for properties that are presented by the Service Provider. 

Privacy Policy

  • Clients have their own right to request the deletion of their data after the conclusion of the Service Agreement, and in case of a termination. 

  • Clients’ personal data and all the information provided to Access Albania will not be used for any purpose other than for market research, selection, analysis and presentation to the client. 

  • Clients’ personal data and all the information provided to Access Albania will not be shared with any other entity, no matter the purpose. 

  • Clients’ personal data and all the information provided to Access Albania will be safely kept private and not misused by the Service Provider.  

  • The entire process of purchasing and after the purchase as well, the Service Provider will safely keep all the information by not sharing it or misusing it. 

Payment Details:

  • The price of the service agreed to be provided is priorly decided on the agreement between the client and the Seller Provider. 

  • The price inclusions are stated in the Service Agreement.

  • There is no prior requested payment except in cases of certain specific requests which need a guarantee for deciding and following the entire process of the service. 

Contract Termination:

  • Both parties can request a termination of the contract if the other party is not respecting the agreement.
